These Website Terms and Conditions (terms and conditions) cover the terms on which you may use the site. By using this site you accept that you are bound by these terms and conditions. If you do not accept them, please do not use the site.

TERMS AND CONDITIONS OF SALE

The below Terms and Conditions of Sale (terms of sale) set out the terms applicable to the sale of our digital products for your information.

 

PURCHASE OF DIGITAL PRODUCTS

These terms of sale (together with any relevant documents referred to in them and including our Website Terms and Conditions) set out the terms on which we supply any of the following products via our site to you:

By placing an order for digital products through our site, you warrant that you are legally capable of entering into binding contracts, that you are at least 18 years old and that you are purchasing our digital products for use within your business. You further warrant that you will not hire, exchange, lend, lease or resell the files, with anybody else other than maybe allowed under the terms of any licence that is granted to you as a part of the sale. Where products or items are digitally editable for use in training we will grant permission for you to use, edit or share the information with your trainers or students and any accrediting bodies. Where you are unsure of your liability or rights please contact us at academystartupexperts@outlook.com

By placing an order for digital products through our site you agree that we may store, process and use personal data collected from you for the purposes of processing/fulfilling your order only. We work with third parties to process your payment (for example, PayPal) and they will also have access to your personal data to enable them to help us process/fulfil your order only. More information on how we may store, process and use your personal data is contained in our Privacy Policy.

All of the digital products that are available for sale on our site are owned or controlled by our licensors, or us. Upon payment of the price for any of these digital products, we grant you a non-exclusive, non-transferable licence to use the digital products for your own business use.

You shall not redistribute, transmit, assign, sell, commercially exploit, sub-licence, rent, share, lend, or transfer any digital products that you purchase through this site.

You are responsible for ensuring that you do not lose, destroy, or damage any digital product you purchase through this site. If a downloaded file is corrupt or has errors, please inform us via email within 7 days to academystartupexperts@outlook.com. You have 30 days in order to download your files before the links expire. It is your responsibility to ensure you download, save and create a backup of your digital files. The Academy Start Up Experts are not responsible for expired links, lost files or files lost due to stolen or damaged equipment. Please ensure you have backup files of your purchase.

In the event of a request for resending links or uploading lost files, this is chargeable at £25 per order, plus a £1 charge for each file to be resent. Details on how to pay will be sent upon request. We can only resend files up to 12 months from the date of purchase. Please allow 7-14 days for files to be resent.

You are responsible for ensuring that any hardware you use to download and/or access these digital products function correctly with this site. You acknowledge and agree that the provision of all these requirements is your responsibility and is at your own cost. We are not obliged to ensure that our products are compatible with every manufacturer of mobile handsets.

PLACING AN ORDER

After placing an order for any digital products via our site, you will receive an e-mail from us acknowledging receipt and setting out the details of your order.

The contract for the purchase of any digital products will only be formed when you have agreed to our terms of sale, we have received payment in full for the digital product you are purchasing and we make the digital product available for download. We reserve the right, in our sole discretion to reject any order we receive.

AVAILABILITY

All digital products featured on our site are subject to availability. We reserve the right to change or remove a digital product or other content on the site at any time without notice or liability to you.

Digital products will normally be available to download within 48 hours upon purchase. There may be occasions when they are not available and we make no guarantee that any digital product ordered will be made available immediately within 48 hours (for example, if the site is taken down for maintenance or there is another technical issue). In such cases, we will use our best endeavours to give you access to your downloadable digital products as soon as possible following your purchase.

Where we are unable to provide you with any digital products that you have purchased, you agree that we can offer you either alternative goods to a similar value (upon your agreement that the alternative goods are suitable) or a complete refund. We will not be liable for our inability to fulfil a particular order from you.

PRICE AND PAYMENT

The price of any digital product will be as quoted on this site at the current time are liable to change at any time, but changes will not affect orders in respect of which we have already taken payment and made the download available.

Please note that some network/service providers may charge you an additional amount for downloading digital products to a mobile handset. We recommend that you contact your network/service provider to understand the nature and extent of any additional charges before downloading to a mobile device.  Note that overseas roaming charges may also apply. We will not be held liable for any such charges.

By providing the details of a credit or debit card or payment account to be debited, you confirm that you are authorised to purchase the digital products and that you have the permission of or are the holder of the credit or debit card, PayPal or other account being used to pay for the transaction. All card payments and cardholder details may be subject to validation checks carried out by us and/or the card issuer. If any validation checks are required, we will not be held liable for any delays or non-delivery nor are we obliged to.

In respect of validation checks and authorisation carried out by the card issuer, if the issuer of your card refuses to authorise payment we will not accept your order and we will not be liable for any delay or non-delivery or any bank charges applied to you. We are not obliged to inform you of the reason for the refusal.

ACCREDITATION 

Accreditation company's course review procedures and requirements may vary. Whilst we endeavour to ensure all manuals meet the requirements of many of the main accreditation providers, we cannot guarantee that some changes may be required.

Due to the fact we sell manuals around the world, sometimes this may flag on plagiarism checks as others may have used our content online. As we hold the rights to the content, we can provide proof that we own the copyright to all manuals and content if this arises. Sometimes, you may be asked to rewrite a sentence, paragraph or section of the manual, which is out of our control.

Images used are stock images purchased through the main stock sites, whereby we hold a license for use.

Requirements of accreditors not only vary between companies but also may vary from time to time within the same company. Where a manual or manuals have passed many times before, legislation and/or company preferences may require an update or edit to the manuals.

Manuals sold are written to save you as much physical time as possible, but you are purchasing them on the recognition that they are fully editable and that small changes may be required before they pass your accreditation company's processes.

The Academy Start Up Experts are not responsible for any requests or requirements set by your chosen accreditation company. We endeavour to ensure that manuals contain everything required by as many companies as possible, and we regularly look to update and edit manuals to ensure they are compliant.

No refunds, either in full or partial will be issued for any changes required by accreditation companies. We will be happy to try and help where issues are likely to be based on new changes or legislation. Feedback is always essential to ensure we can constantly keep manuals updated as much as possible.

REFUNDS

In accordance with law, no refunds will be given as businesses are exempt from Consumer Contracts (formerly distance selling) regulations.

If digital products are found to be defective, we shall have the right to attend to the cause of the problem and restore the digital products to functioning order, or offer you a repeat download. You shall not have the automatic right of refund in this case. You must notify us within 30 days of the download of the digital product that it is defective at academystartupexperts@outlook.com. If we are unable to fix it and a repeat download does not resolve the issue, we will provide you with a full refund within 30 days of ascertaining that the issue cannot be resolved.

EVENTS OUTSIDE OUR CONTROL

We will not be liable for any failure or delay to perform any of our obligations under a contract for a digital product that is caused by events outside our reasonable control.

IMPORTANT: Please read these terms and conditions, as your contract starts from the date that you book your course online and is legally binding.

 

BOOKING A COURSE 
Please fill in the booking form with all relevant information, this helps to prepare your certificate, and allows the tutor to see what prior knowledge you hold. If the course you are attending has pre-requisites, we will need a copy of the relevant certificate emailed to us. The course cannot go ahead until we have received this.

A non-refundable booking fee is required to secure your place and the training date is NOT confirmed until the this is received.

Once we send the invoice for the non-refundable booking fee, we hold training dates on provisional hold for a maximum of 24 hours, after which the date will be released.

Once we receive your booking fee, we will send you via email your home study manual, anatomy and physiology manual and health, safety and marketing manual.  When you have read through these a few times, you need to email your tutor and ask for the home study questionnaire, which will need to be completed and returned to your trainer  at least 4 days prior to the course date. Completion and return of the home study questionnaire is mandatory and if you fail to provide it within given time, then you will not be eligible to attend the course with no refund available. You must achieve 100% pass on the home study questionnaire in order to receive your certificate (all the answers are in the manual).

7 days before the course is held, full payment should be completed and paid direct to your trainer.

 

PAYING FOR YOUR COURSE 
The non-refundable booking fee for the course needs to be paid direct to Zen Zone Therapy Training Experts.   For the final part of the payment for the course, your tutor will provide you with details on ways in which this can be paid.

All booking fees and full course payments are STRICTLY NON-REFUNDABLE AND NON- TRANSFERABLE. We do, however, recognise that an attendance problem may arise, so we will allow a transfer to an alternative course provided 30 days' notice is given and a nominal £15 admin fee will be charged. If students do not attend on the day without prior notice, they will lose, or be responsible for, the full course fee.

It is the responsibility of the student to ensure that the courses you apply for are suitable for your requirements and that you have the pre-requisite qualifications and the competence to be able to achieve the objectives of this course. All student information will be confidential, nor will it be disclosed to other parties.

To the maximum extent permitted by law, Zen Zone Therapy Training Experts accepts no responsibility for any direct or indirect loss or damage, foreseeable or otherwise, including any indirect, consequential, special or exemplary damages arising from the use of this website, or any information contained therein.

It is your responsibility to check that your insurance will cover you for these courses.

 

CONFIRMATION OF COURSE DATE
Courses will still run even if there's only one student booked on but you may need to bring models to practice on.  Your trainer will confirm this with you.

We will give you at least 7 days' notice if the course is under-subscribed to give you time to find a model. Tutors will try and provide models if you are finding it difficult to bring one yourself but is not their responsibility to do so.

 

BOOKING FEE
The booking fee is totally non-refundable. If you cannot attend the course, your booking fee will not be returned to you. You may be able to transfer to the next course date if adequate notice is given.

 

1-2-1 TUITION

If a student specifically requests 1-2- 1 situation, the student will need to supply model(s) to practice on .  We can sometimes arrange a model for you if you are unable to find a model.

An additional 25% of the fee paid direct to the trainer will be applied if you specifically request 1-2-1 tuition or we travel offsite to you.

 

COURSE MANUALS
The course manual is the property of Zen Zone Therapy Training Experts and is protected by copyright.

You cannot reproduce any of the manual without express written permission from us. You will be in breach of contract by using the manual or teaching the subject from the manual.

The home study manual is emailed to you prior to the course once you have paid the non-refundable booking fee. If you cannot print the manual off, we can post you a copy, but this will incur printing, postage and packaging costs of £15.

 

NOTICE OF ATTENDANCE
If you cannot attend the course, 10 days' notice must be given.
Notice of 10 days or more:

  • Moving to another course date: £15 administration charge
  • New date and course to be re-arranged within 6 months.
  • Cancellation of course: booking fee is not refundable

 

Notice of less than 10 days:

  • Moving to another course date: £30 administration fee
  • Cancellation of course: booking and training fees not refundable

 

Notice of less than 5 days:

  • Moving to another course date: £60 administration fee
  • Cancellation of course: booking and training fees not refundable

 

Notice of less than 72 hours

  • Moving to another course date: £90 administration fee
  • Cancellation of course: booking and training fees not refundable

 

Notice of less than 48 hours

  • Moving to another course date: £150 administration fee
  • Cancellation of course: booking and training fees not refundable

 

COURSE PAYMENT
In the event of a genuine reason for cancellation (proof of which may be required) a request for transfer to a later course will be considered at our discretion. Courses transferred will incur an administration fee of £15, otherwise the above charges will apply.

 

INSURANCE
To practice the therapy that you have just studied by Zen Zone Therapy Training Experts, valid insurance is needed. Information regarding this is found in your manual. It is your responsibility to check that your existing insurance company will accept the course for insurance purposes.

 

PROFESSIONAL STANDARDS
Zen Zone Therapy Training Experts teaches courses to a high standard adhering to all health and safety standards throughout.
Certificates are given out to students who have shown competence throughout the course and submitted case studies which are deemed acceptable. However, we have the right to withhold the certificate if the tutor, assessor or training director deems the student to not have reached a competent standard. Further case studies will be set, and reassessment will be arranged. There may be an additional charge for this.

For professional standards, a certificate is awarded to show competence, but it is expected that each therapist practices at least 6-10 times before taking payment and advertising for clients.

 

ATTENDING THE COURSE
You will be expected to turn up punctually for the course, as provided by your tutor. Any medical conditions should be discussed prior to the course and noted on your booking form. You should be prepared to give and receive treatments throughout the course to complete and be deemed competent.

Please wear comfortable clothing i.e. jogging bottoms and a T-shirt are acceptable (no Jeans please), flat shoes or socks for footwear.

You cannot perform most treatments with long nails, so please ensure your nails are at a suitable length, otherwise you will be asked to leave the training and no money will be refunded.

Any items left will need to be picked up. If they are posted out Zen Zone Therapy Training Experts holds no responsibility to them arriving and a fee will be charged for postage. Items will be kept safe for collection.

If you do not complete and return the home study questionnaire 4 days prior to the course, you will not be able to attend the course and you will lose all monies paid

 

COMPLAINTS PROCEDURE
In the unlikely event your training course with us does not meet your expectations, the following policy should be followed:

Stage 1: Within 24 hours of attending the course, speak to your tutor (verbally or via email) if you feel you can in a calm manner to try and resolve any issues you may have.

Stage 2: If your complaint has not been resolved within 72 hours, send in a written copy of the facts of your complaint to the Training Director: click here to email.  Complaints will only be taken forward in this format so please do not send them via social media or text message.

Your complaint will be investigated in full (the person you have complained about will have to be notified) and a conclusion drawn based on evidence from both parties. You will be notified with the outcome within 14 days of receipt of your complaint (assuming the tutor is not on holiday).

 

DISCLAIMER:
Our courses are taught to a high standard throughout,  We do not train you nor can any therapist diagnose medical conditions and should not be treated as a substitute for medical care. Contraindications and benefits are discussed as part of the course but are not intended to represent medical advice, nor be deemed as a treatment to cure or prevent disease.

All manuals have been checked and approved for accreditation through Alliance of Beauty Practitioners, International Practitioners of Holistic Medicine, Complementary Medical Association or  Towergate Health & Beauty. In the case of courses that we teach for other recognised training providers these will be accredited under the other recognised training providers.

Zen Zone Therapy Training Experts accept no liability for injury or loss to person or property, nor do we hold responsibility for damage caused by you to another person after you have received your training.

 


 

USER RIGHTS OF ACCESS

You have permission for temporary, non-exclusive use of the site. Zen Zone Therapy Training Experts and The Academy Start Up Experts reserves the right to withdraw or change the content of the site and these Terms and Conditions at any time without notifying you and without having any legal responsibility towards you.

You are not allowed to copy, modify, duplicate, create derivative works from, frame, mirror, republish, download, display, transmit, or distribute all or any part of the site.

You are also not allowed to licence, sell, rent, lease, transfer, assign, distribute, display, disclose, or otherwise commercially exploit, or otherwise make the site and/or any documents or online resources (including our digital products after these have been purchased by you) on the site available to any third party.

You are responsible for configuring your own computer and software to access the material and content on our site including downloadable files and resources, when purchasing our digital products. We do not warrant that the way we deliver data to you is compatible with your software or with the way your mobile device, computer or tablet is configured. Although we do our best to protect our site, we are not responsible for any viruses, bugs or similar issues. We advise that you use your own virus protection software to protect yourself.

You agree to follow our Acceptable Use Policy.

We frequently update the site and make changes to it, but we have no duty to do this. This means that content on the site may be outdated or incorrect. We will have no liability to you for any losses or damage you may suffer from your reliance on any of our materials.

We do not save your credit card details or share customer details with any third parties and we follow our Privacy Policy in handling information about you. By using the site, you agree to us handling this information and confirm that the data you provide is accurate.

VARIATION

We may change these terms and conditions from time to time. Please ensure that you check for any changes regularly, as you are bound by them if you use this site.

OUR RESPONSIBILITY TO YOU

We do not guarantee the accuracy of material on our site, and you are responsible for the way you use its content.

We shall not limit or exclude our liability for:

  • death or personal injury;
  • fraud or fraudulent misrepresentation; or

  • any act, omission or matter, liability for which may not be excluded or limited under any Applicable Law.

We shall not be liable to you for any indirect, special or consequential loss or damage, including:

  • loss of profit;
  • loss of goodwill;

  • loss of savings; or

  • loss of contract.

We also exclude, but only as far as legally possible, all terms and warranties or promises implied by law or by statutes.

Although we try to make the site available at all times, we do not warrant that your use of the site will be uninterrupted.
